Rental conditions ASA 2.0

Dear customers,

Please read the rental terms and conditions before signing the contract. Once the rental agreement is concluded, our rental terms and conditions are considered accepted!

It is essential that all customers familiarize themselves with the safety information regarding the dummies before using them! This information is included with the rental dummies and can also be downloaded and copied using this QR code.

Important: For liability reasons, we only lend our breathing apparatus training masks to public safety authorities and their private support organizations (associations). This offer is expressly not available to private individuals!

The breathing apparatus dummies are always issued in pairs (to equip a team). The staggered arrangement is as follows:
The rental price is adjusted according to the quantity selected. The price is for two dummy breathing apparatuses. The dummies are rented on a weekly basis to allow the renter reasonable usage time. The minimum rental period is one week, and the maximum is four weeks. Alternative rental terms are available upon request.

Only a limited number of rental dummies are available. Interested parties can check current availability on the rental calendar on our website. There is no guarantee of availability of the rental offer or of the full quantity of the desired dummy. All orders placed in the webshop are initially considered expressions of interest and will only be confirmed by Feuerkids® via email. The rental agreement only comes into effect upon this confirmation.

The rental agreement is concluded between the lessor (Feuerkids® Benjamin Thoran, Am Heinichenberg 18, 63486 Bruchköbel) and the respective registered invoice recipient (lessee).

The rental price includes shipping the dummies to the renter . Return shipping is at the renter's expense.
Unless otherwise agreed, only insured and tracked packages are permitted for shipping. The value of the package is calculated as half the new price of a dummy breathing apparatus. In case of loss , Feuerkids® will file a claim against the renter, who can then pursue this claim against the shipping provider. The rented dummies must be returned immediately after the rental period ends, but no later than the next business day. For dummies returned late, the lessor may claim damages or charge for the involuntarily extended rental period at the standard rental rate.

Feuerkids® generally does not require a deposit for the dummy fireworks. However, Feuerkids® reserves the right to request a deposit from certain renters, particularly if the renter has a history of unreliability or if there are other concerns regarding their trustworthiness.

The renter is responsible for the safe and careful handling of the delivered dummies. The delivered goods are dummies intended for use under conditions similar to those of real-world operations and are subject to visual and technical wear and tear. As a renter, you must therefore expect that you will not receive a dummy that is brand new or visually flawless. Wear and tear and damage are tolerated by the lessor to a certain extent, as they are unavoidable and can occur as a result of use.

The renter must return the equipment in a clean and tidy condition at the end of the rental period . The carrying handles of the dummies must be folded neatly. Any necessary cleaning services that the landlord must provide to restore the equipment to usable condition will be charged to the renter subsequently, depending on the extent of the cleaning required.

In case of damage to or destruction of the dummies, the costs for repair or replacement will be borne by the tenant.
A fee will be charged. The amount depends on the necessary effort to restore the dummy to a usable condition. Any damage incurred during the rental period must be reported to the lessor immediately, and further steps must be discussed with them. For safety reasons, defective equipment must be taken out of service immediately and secured against unintentional use. In case of damage, the lessee is not entitled to a replacement from the lessor. If the lessee steals the rented item, the lessor will charge them the full cost of replacing the dummy.

The lessor is responsible for delivering the ordered quantity to the customer at the agreed time (the rental start date). If the equipment is made available significantly later than the agreed time, the lessee may, after consulting with the lessor, extend the rental period, provided the lessor agrees. If the delivery of the equipment is delayed by the shipping provider, claims must be made to them. For safety reasons, the customer should always allow for a delivery time of 3-4 business days when planning their schedule.

Technical Notes: The rental items may differ in their technical specifications, performance, and appearance from the descriptions of the purchased items. Since the rental service is provided from a pool of dummy models, the renter has no right to choose a specific dummy or model with a particular appearance. However, the lessor will, to the extent possible, send pairs of dummies that are technically and visually identical to ensure a uniform appearance for the customer.

These rental terms and conditions come into effect on September 1, 2023 , and supersede all previous versions upon publication. Should any part of the contract be rendered invalid due to a legal error, all other parts of the contract shall remain valid. All information has been provided to the best of our knowledge and belief. In these rental terms and conditions, the parties to the rental agreement are described as legal entities and are therefore referred to in a gender-neutral manner.
